Officers with the Suffolk County Sheriff’s Department say they observed a motorist stopped on the shoulder of County Road 97 in the Town of Islip with hazard lights on, sitting in the driver’s seat with the engine running on Sunday, Sept. 22 around 1:20 a.m.

During interviews, police say the driver, identified as Melvin Banos-Rivas, 31, of Brentwood, was displaying signs of intoxication.

Banos-Rivas was subsequently asked to participate in a series of field sobriety tests, which police say he did not pass.

Banos-Rivas submitted to a chemical breath test that gave a BAC reading of .19, according to police.

Banos-Rivas was arrested, charged with DWI and is scheduled to appear in court.
